For an ordinary UAE resident, more than 180 consecutive days abroad generally makes the residence permit void under Article 59 of Cabinet Resolution No. 65 of 2022—even if the printed expiry date is later. Article 60 creates specific exceptions, so the same consequence does not apply to every residence category. There is a recovery procedure for some residents, but it is not one permit for every emirate or residence category. For eligible non-Dubai residents, the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) publishes a return-permit service with specific conditions and fees. Dubai residents use Dubai's General Directorate of Residency and Foreigners Affairs (GDRFA) route instead. Valid Golden, Green and Blue Residence holders are among the explicit ICP exceptions to the long-absence permit requirement.
A return flight or an Emirates ID showing a future date is not confirmation of your current immigration status. The right first step depends on who issued the residence, what category you hold, whether that residence is still current, and how many consecutive days you have been abroad.
Five situations that lead to different decisions
| Real situation | What the official rules say | What to do before booking |
|---|---|---|
| Ordinary Abu Dhabi residence, 150 consecutive days abroad, current visa | The general over-180-day absence problem has not yet arisen. The visa could still be affected separately by cancellation or its actual expiry. | Check the permit status in ICP; do not wait until the day you fly to learn that your employer or sponsor cancelled it. |
| Ordinary Sharjah residence, 205 days abroad, 100 days of permit validity remaining | You have crossed the general limit. The ICP long-absence permit may be available, provided there is a valid reason, supporting proof and the other service conditions. Approval is not automatic. | Apply from abroad through the ICP permit service, not simply by showing a return ticket at check-in. |
| Ordinary Abu Dhabi residence, 205 days abroad, only 20 days of permit validity remaining | The published ICP recovery service requires more than 30 days of remaining residence validity at application. Your printed card's 20 days do not satisfy that condition. | Get an individual decision from ICP and your sponsor on the required new entry/residence route; do not pay the long-absence application assuming it can override this threshold. |
| Valid Golden, Green or Blue Residence, more than 180 days abroad | The ICP service expressly exempts these residence categories from applying for this specific return permit while the residence remains valid. | Verify your actual residence status and category before departure; the exception does not renew an expired or cancelled permit. |
| Ordinary Dubai-issued residence, more than 180 days abroad | The ICP recovery service expressly excludes Dubai residents. Dubai GDRFA publishes a separate return-permit-for-residents-abroad service. | Check current Dubai residence status with GDRFA and use the Dubai return-permit route, not ICP's Abu Dhabi/Sharjah fee or eligibility assumptions. |
These examples concern absence from the UAE, not overstaying inside the country. Article 60 expressly protects certain valid residence permits in specified circumstances, including qualifying foreign students, investors and people abroad for treatment with the required medical documentation. A person must still establish that their actual residence and facts fit the particular statutory category; a job title, investment claim or family relationship on its own is not proof of eligibility.
More than six months outside: the actual ICP conditions
Article 59 of Cabinet Resolution No. 65 of 2022 establishes the general rule: a foreign resident’s permit is deemed void when an absence from the UAE exceeds 180 consecutive days. Article 60, in the same official regulation, preserves valid residence permits for expressly listed categories until their normal expiry. Thus 180 days and six calendar months should not be treated as interchangeable for every date calculation, and the ordinary rule must not be applied to a person covered by an exception. The UAE Government residence overview explains the same distinction.
For an eligible ICP-issued residence (Abu Dhabi, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah or Fujairah), the actual ICP service card, updated 11 December 2024, says:
- Apply while outside the UAE and after completing 180 days abroad, not as a preventive request during a shorter holiday.
- Have more than 30 days of residence validity remaining when submitting the application.
- Provide proof of a valid reason for staying out longer than 180 days; an ordinary desire to extend a holiday is not stated to guarantee approval.
- If an establishment sponsors the applicant, the applicant or sponsoring establishment may submit.
- If approved, enter within 30 days including the approval date. This is a limit on use of an approved permit, not an extra 30-day entitlement to remain abroad or a guarantee of admission.
- Dubai-issued residents cannot use this ICP service.
The ICP service names Golden, Green and Blue Residence holders, plus the husband of a UAE national woman sponsored by her, as exempt from that ICP return-permit application while their residence is valid. Article 60 is a separate statutory list covering, among other cases, students enrolled at educational institutions outside the UAE with valid UAE residence permits; investors holding valid UAE residence permits; qualifying foreign patients and their companions with a UAE-certified medical report; and specified official overseas assignments and diplomatic circumstances. The legal text does not say that every short course, employer trip, informal investment or family connection automatically meets those descriptions. Confirm the precise category and supporting evidence with the residence issuer before relying on an exception.
What would an ICP return permit cost?
The published ICP service distinguishes a fee for each month of delay after six months from a separate smart-service fee:
| Officially listed component | Published amount |
|---|---|
| Issuance fee for each month of delay after six months | AED 100 |
| Smart Services fee | AED 100 |
The final amount cannot be calculated reliably from the published wording alone. The same ICP service card also describes AED 100 for each 30 days or part spent outside the UAE, without clearly reconciling that statement with the fee-table wording “each month of delay after 6 months.” It is unclear from these two passages exactly which days are chargeable and how partial periods are counted for an individual case. Accordingly, neither a 205-day absence nor a longer one is assigned a fixed total here. Ask ICP for the actual transaction assessment before paying; the AED 100 Smart Services fee is a separate published component. These are ICP items only, not Dubai GDRFA charges.
The same service lists proof of the reason for absence, online or app submission using UAE Pass, and a stated service-completion target of two days. That published target is not a guarantee of approval before a particular flight.
Dubai: the same travel problem, a different authority
If Dubai issued your residence, do not select the ICP “outside more than six months” permit merely because you see it in an online article. ICP explicitly says its service does not cover Dubai.
The official GDRFA Dubai online service portal separately lists “Return Permit for a Resident Outside the Country” (Arabic: تصريح عودة مقيم خارج الدولة). The publicly readable portal confirms that such an application route exists, but does not establish the current detailed Dubai approval categories, exact fee, processing deadline or validity for your case. It would be misleading to paste ICP's AED 100 increments or “more than 30 days remaining” rule into a Dubai application as if GDRFA had published those same conditions.
Use GDRFA's Dubai visa-status service, then request the actual return-permit requirements from GDRFA/Amer before purchasing a non-refundable flight. The UAE Government's July 2026 contact directory gives 800 5111 from within the UAE and +971 4 313 9999 from outside for Dubai immigration enquiries.
A Dubai-based worker who has been away 210 days cannot simply use the Sharjah ICP permit or its published fee items. The practical difference is where the residence was issued, not merely which airport the flight uses.
Golden, Green, Blue, students and investors: who is actually exempt?
Golden Residence is a particularly clear case. The UAE Government's Golden Visa page updated 26 February 2026 explicitly recognises the ability to stay abroad beyond the normal six months without losing valid Golden Residence because of that absence. ICP's own long-absence service similarly identifies Golden, Green and Blue Residence holders as people who do not need its special return permit while their residence is still valid.
Article 60 sets out additional exceptions in law, not just an informal government FAQ. Its published categories include students enrolled outside the UAE who hold valid residence, investors holding valid residence, certain medical patients and companions with an approved medical report, and specified government, scholarship and diplomatic circumstances. Those descriptions have conditions: for example, a medical-treatment exemption refers to a report certified by the UAE’s competent authorities. The text does not turn every foreign employee’s training trip or anyone who owns a small business into an automatically verified case. A standard employer-sponsored residence is also not the same as a Golden Residence issued to a qualifying investor. Keep the permit itself valid and establish the exact Article 60 category and evidence with the competent authority.
Family members have their own permit records. The general government rules state that a dependant's residence does not extend beyond the sponsoring resident's residence. ICP's cancellation service also describes family permits that may require separate cancellation or temporary hold when the sponsor's status is cancelled. Therefore a spouse's Emirates ID showing next year is not enough if the sponsor's underlying residence has changed. Confirm each family member's record, not only the head of household's.
What if your residence expired or your employer cancelled it?
This is a different problem from the long absence alone. ICP's service requires more than 30 days of validity remaining; it does not say it can revive an already expired or cancelled residence in every case. If the sponsor has cancelled your residence while you were abroad, do not assume that paying a six-month absence fee restores it. Ask the issuer and employer/family sponsor which new entry and residence process is required.
Another easily confused rule is the UAE's grace period after residence expiry/cancellation while inside the country. ICP's cancellation service lists different in-country grace periods by residence category. Those grace periods are not permission to re-enter after 180 days abroad, and the AED 50-per-day in-country overstay fine is not the AED 100-per-month long-absence permit component. They describe different legal situations.
Employment, insurance and family sponsorship need separate attention. A valid immigration return permit does not automatically restore a cancelled labour contract, re-open cancelled health insurance or reactivate a dependant's status. Treat the immigration record, employment record and coverage record as separate, rather than assuming a single flight fixes all three.
Before you pay for the return flight
Example A — Sharjah employee delayed by treatment: The resident has been abroad 205 days and the ICP record shows 100 days of residence validity left. They can examine the ICP application with their supporting reason and official fee path; the precise number of chargeable months and the final amount must be shown by ICP, not inferred solely from their 205-day absence. They must wait for the issued approval and then return within its 30-day window, rather than present a payment receipt as a travel permit.
Example B — Dubai-based employee away 205 days: The Sharjah ICP permit is not their route. They need the Dubai GDRFA return service, plus current residence confirmation. Using the wrong emirate's website or quoting another emirate's fees is a preventable mistake.
Example C — Golden Residence holder away 240 days: The public ICP rule exempts this residence category from the special absence permit while the permit remains valid. The correct question is therefore whether their actual Golden Residence remains current, not how much of the standard late-return fee they owe.
The next move is concrete: read your exact issuing emirate and residence category, obtain the live status from ICP or GDRFA as applicable, and only then select the permitted entry route and book travel. Airline boarding approval and a paid ticket are not themselves an immigration decision. If you are newly applying for UAE entry rather than returning on residence, use the separate UAE entry and visa guide.
